These Terms of Use (“Terms”) form a legal agreement between you and Food Mood (“Food Mood”, “we”, “us”, or “our”) governing your use of the Food Mood application and website (the “App”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Health disclaimer. Food Mood is a self-tracking and wellness tool. It is not a medical device and does not provide medical, nutritional, or psychological advice, diagnosis, or treatment. Always consult a qualified healthcare professional about your diet, health, or any condition. Do not disregard professional advice because of something in the App.

1. Eligibility

You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the App. By using the App you represent that you meet these requirements.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes, subject to these Terms and, where applicable, the App Store Terms of Service and Usage Rules. When the App is obtained through the Apple App Store, this license is limited to use on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the applicable App Store terms.

3. Acceptable Use

You agree not to:

Copy, modify, reverse engineer, decompile, or create derivative works of the App except as permitted by law;
Use the App for any unlawful purpose or in violation of these Terms;
Interfere with or disrupt the App or its security; or
Sell, rent, sublicense, or otherwise commercialize the App without our written permission.

4. Your Content

The entries, notes, and data you create in the App belong to you and are stored on your device as described in our Privacy Policy. You are responsible for backing up and safeguarding your own content.

5. Intellectual Property

The App, including its design, text, graphics, and software, is owned by Food Mood and protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

6. Apple App Store — Additional Terms

The following terms apply when you obtain the App through Apple's App Store. They are included to satisfy Apple's requirements for licensed applications:

Acknowledgement. These Terms are between you and Food Mood only, and not with Apple. Food Mood, not Apple, is solely responsible for the App and its content.
Scope of license. The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
Maintenance and support. Food Mood is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support services.
Warranty. Food Mood is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product claims. Food Mood, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection or privacy law.
Intellectual property claims. Food Mood, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes that third party's intellectual property rights.
Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

7. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Food Mood will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App, if any.

9. Termination

These Terms apply until terminated. We may suspend or terminate your access if you breach these Terms. You may end this agreement at any time by ceasing to use and deleting the App. Sections that by their nature should survive termination will survive.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Food Mood operates, without regard to conflict-of-laws principles, except where mandatory consumer protection laws of your country of residence apply.
